Kaiser Permanente Bad Drug Lawsuit

Here is a new and interesting lawsuit against Kaiser.  Irma Scholz is suing Kaiser & Dr. Jina Lisa Janava in Alameda County.

Irma Scholz claims Dr. Jina Lisa Janava prescribed a drug called "Carbamazepine".  Irma Scholz states that this medication is not only known in the Medical Community but listed in the Physicians Desk Reference that persons of "Asian Desent" are predisposed to develop Stevens-Johnson Syndrome from taking this medication.

What is most interesting about this lawsuit is that they are citing Burks v. Kaiser Foundation Health Plan (2008) that Irma Scholz does not have to arbitrate this Medical Malpractice Claim and instead can sue.

Good luck to Irma Scholz and her lawyers,  all Medical Malpractice Claims should in heard in court so doctors and health plans can not hide their failures.
